As you are likely aware, complaints were filed on Monday, March 24, 2025, with the Maryland Attorney General’s Office regarding violations of the Maryland Open Meetings Act (OMA). Eleven complaints focused on noncompliance with OMA Chapter 6 Rules were filed with the Maryland States Attorney’s Office.

The Open Meetings Act is a critical safeguard for government transparency, ensuring that the public has access to the decision-making processes that shape our elections. Strict adherence to this Act fosters confidence in the integrity of our electoral system.

First, I want to recognize and commend the Boards of Elections in Frederick, Harford, and Washington counties for their commitment to transparency. These jurisdictions set a high standard, consistently posting agendas, meeting minutes, and meeting notifications in a timely manner. Their websites are user-friendly and accessible, making it easier for the public to stay informed and engaged.

However, there is still work to be done statewide. Of Maryland’s 24 election jurisdictions, seven are not in compliance with OMA Chapter 6 Rules. Key issues include:

  • Failure to post meeting agendas.
  • Failure to post meeting minutes.
  • Lack of timely meeting notifications.

Given these concerns, I respectfully seek clarification on the following:

  1. What is the most effective process for holding local boards accountable when they fail to comply with Open Meetings Act requirements?
  2. When the State Election Director evaluates local election directors, is constructive feedback provided to help improve their transparency practices?
  3. What steps is the State Board of Elections taking to ensure that all local boards uphold the highest standards of transparency and public engagement?

Strengthening oversight and providing clear guidance to local boards will reinforce public trust and uphold the integrity of Maryland’s elections at both the state and local levels.
